Bollywood actress Celina Jaitly has received significant judicial relief after the Delhi High Court directed India’s Ministry of External Affairs to facilitate legal assistance and ensure the safety of her brother, retired Major Vikrant Jaitly, who has been in custody in the United Arab Emirates since September 2024.
The court’s intervention follows a prolonged period of uncertainty and limited communication after retired Major Vikrant Jaitly was detained in a national security-related case. Over the last sixteen months, Celina Jaitly has pursued multiple avenues to secure legal representation and consular support, culminating in a decisive order that strengthens institutional involvement and safeguards due process under international law.

A judicial push for safety, access, and representation

The hearing before the Delhi High Court marked a turning point in a case that had been marked by opacity and prolonged separation from family. Recognising the gravity of a retired Indian Army officer’s extended detention abroad, the court directed the Ministry of External Affairs to act expeditiously. The order emphasised the need to ensure the detainee’s safety, enable regular contact with family, and facilitate access to competent legal representation within the UAE’s legal framework.

Celina Jaitly publicly acknowledged the court’s directive, describing it as a step toward protecting the rights of a soldier. She noted that after months of continuous efforts, arrangements had finally been put in place for legal counsel to represent her brother in the UAE. Her statement underscored the emotional and procedural challenges faced by families when a citizen is detained in a foreign jurisdiction, especially under national security provisions that often limit communication.
In compliance with the court’s direction and with coordination from the Ministry of External Affairs, a prominent UAE-based law firm, Khalid Almarri & Partners Advocates, was engaged to handle the case. The firm has undertaken to represent Major Vikrant Jaitly without charging any fees, committing to pursue his rights under applicable international norms and domestic UAE law. This development not only ensures professional representation but also provides a structured channel for legal remedies and procedural clarity.

The High Court’s order also addressed the long-standing concern of access. Since the detention in September 2024, the family’s contact with Major Jaitly had been sporadic and, at times, completely severed. The directive to facilitate contact aims to restore a basic humanitarian safeguard, enabling updates on health, legal progress, and wellbeing. Such access is critical in cases involving extended detention, as it mitigates uncertainty and supports transparent legal processes.
For the Ministry of External Affairs, the order reinforces its consular responsibilities. While sovereign legal processes of another country must be respected, the MEA’s role includes ensuring that Indian nationals abroad receive fair treatment, legal access, and consular support. The court’s instruction places urgency on these duties, signalling that sustained delays or gaps in facilitation are unacceptable where liberty and safety are at stake.

Sixteen months in custody and a family’s sustained legal fight

Retired Major Vikrant Jaitly had been residing in Dubai since 2016 following his retirement from the Indian Army. According to information shared by the family, he was taken into custody by UAE security authorities in September 2024 in connection with a national security case. The precise allegations and procedural status have remained largely undisclosed, a common feature in sensitive cases that can restrict public detail and complicate external advocacy.

Over the ensuing sixteen months, the family’s efforts to obtain clarity and assistance faced significant obstacles. Operating from India, Celina Jaitly encountered jurisdictional limits that constrained direct legal action. Efforts to secure representation were hindered by unfamiliar legal systems, language barriers, and the complexities of national security proceedings abroad. Despite these challenges, she continued to engage with Indian authorities, legal experts, and diplomatic channels.

When prolonged attempts failed to restore contact or secure formal legal representation, Celina Jaitly approached the Delhi High Court, seeking judicial direction to compel institutional support. Her petition highlighted the duration of detention, the lack of consistent communication, and the need for immediate legal aid to ensure her brother’s rights were protected. The court’s response acknowledged these concerns and translated them into actionable directives for the Ministry of External Affairs.
Following the court’s order, the engagement of Khalid Almarri & Partners Advocates provided a tangible legal pathway. The firm’s pro bono commitment is particularly notable, reflecting a recognition of the case’s humanitarian and rights-based dimensions. By operating within the UAE’s legal system, the firm is positioned to pursue remedies, seek access, and navigate procedural requirements that are otherwise inaccessible to families abroad.”

Celina Jaitly expressed gratitude to the Ministry of External Affairs for its cooperation following the court’s direction, stating her confidence that coordinated efforts would lead to progress. She framed the struggle not only as a family’s plea but as a matter of dignity for a soldier who had devoted his youth to national service. Her statements resonated widely, drawing attention to the broader issue of consular protection for citizens facing legal challenges overseas.

The case also highlights the delicate balance between respecting a host country’s laws and ensuring that fundamental rights are upheld. International law recognises the sovereignty of states in enforcing their laws, particularly in national security matters. At the same time, it emphasises humane treatment, access to legal counsel, and consular communication. The High Court’s directive seeks to operate within this balance, advocating for procedural fairness without encroaching on another nation’s jurisdiction.

As legal proceedings advance under the guidance of UAE counsel, the focus remains on safety, access, and due process. The involvement of the Ministry of External Affairs provides an additional layer of oversight and facilitation, ensuring that communication channels remain open and that the detainee’s welfare is monitored. For families in similar situations, the case underscores the importance of judicial recourse in mobilising institutional support when diplomatic pathways stall.
