The central government has appointed a special legal team, headed by Solicitor General Tushar Mehta, to conduct the trial of Tahawwur Hussain Rana, the Pakistani-Canadian terrorist extradited in connection with the 26/11 Mumbai terror attacks. This decision, announced by the Ministry of Home Affairs (MHA), involves a panel of senior prosecutors to represent the National Investigation Agency (NIA) in all courts, including the NIA Special Courts in Delhi, Delhi High Court, and the Supreme Court of India, for a period of three years or until the trial concludes.

Legal Team and Appointment Details

The appointed team includes Additional Solicitor General S.V. Raju, senior advocate Dayan Krishnan, and advocate Narender Mann. Their role is to handle all trial-related matters for the case RC-04/2009/NIA/DLI, which revolves around the prosecution of Rana and his co-accused David Coleman Headley for their involvement in the 2008 Mumbai attacks. The appointment is made under the powers granted by the National Investigation Agency Act, 2008, and the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.

Rana was extradited from the United States after years of efforts by Indian agencies and was arrested upon arrival in India on April 10. Since then, he has been in judicial custody at Tihar Jail following intense interrogation by the NIA. His interrogation sessions lasted around eight to ten hours daily, aiming to uncover the broader conspiracy behind the attacks.

Case Background and Terror Network

The 26/11 Mumbai terror attack, masterminded by the Pakistan-based terrorist group Lashkar-e-Taiba (LeT), resulted in the death of 166 people and injuries to over 238. Rana is charged with multiple offenses including conspiracy, murder, terrorist acts, and forgery. Investigations have revealed his extensive communication with David Headley, who is currently imprisoned in the US, and his travels across parts of northern and southern India just days before the attack.

The NIA registered the case in November 2009 under various sections of the Indian Penal Code and other anti-terrorism laws. The probe also exposed the involvement of senior LeT and Harkat-ul Jihadi Islami (HuJI) members, such as Hafiz Muhammad Saeed, Zaki-ur-Rehman Lakhvi, and others, who allegedly collaborated with Pakistan’s intelligence agency ISI officials, including Major Iqbal and Major Sameer Ali.

This significant trial is expected to proceed in Delhi, where major transport hubs like Indira Gandhi International Airport, Chhatrapati Shivaji Maharaj International Airport, and Kempegowda International Airport are closely linked to the investigation and security operations surrounding this high-profile case. The appointed legal team will play a critical role in ensuring justice is served through a rigorous legal process in India’s courts.
