Israeli officials are on edge amid reports suggesting that the International Criminal Court (ICC) may seek arrest warrants for their military and political leaders over alleged war crimes in Gaza.
The ICC, headquartered in The Hague, has been scrutinizing Israel’s activities in the occupied territories for the past three years, including actions by Hamas. It possesses the authority to prosecute individuals for grave violations of international law.
Past targets of ICC warrants include figures like Russia’s Vladimir Putin, Libya’s Muammar Gaddafi, and Ugandan warlord Joseph Kony.
Israeli Prime Minister Benjamin Netanyahu has vehemently denounced the possibility of Israeli leaders being listed as wanted by the ICC, branding it “an outrage of historic proportions.” However, his vocal objections suggest that such discussions are underway behind closed doors.
While the ICC has not officially confirmed Israel’s concerns, Chief Prosecutor Karim Khan KC’s visit to Israel and the West Bank in December underscored the seriousness of the matter. Karim Khan toured sites affected by Hamas attacks, emphasizing the need for compliance with international humanitarian law.
The 7 October attacks, which resulted in numerous civilian casualties and hostages, were highlighted by prosecutor Karim Khan as egregious violations demanding ICC attention.
For Israel, prosecutor Karim Khan emphasized the necessity of adhering to legal standards during military operations. Israel faces allegations of failing to adequately protect civilians during its Gaza bombardment, although it maintains that it prioritizes civilian safety.
Moreover, Karim Khan emphasized the urgency of humanitarian aid reaching Gaza’s population, urging both Israel and Hamas to facilitate its delivery.
Israel, not a signatory to the ICC, contends that the court lacks jurisdiction over its actions. However, the ICC’s ruling granting jurisdiction over Gaza, the West Bank, and East Jerusalem since 2015 has complicated matters.
If Benjamin Netanyahu were to face an ICC warrant, it would mark an unprecedented development, stirring concerns among Israelis about potential ramifications.
Former Israeli Ambassador Michael Oren warns that such actions could significantly impact Israel’s societal narrative, potentially reinforcing right-wing sentiments and impeding diplomatic pathways.
