Elon Musk’s X sues New York over law requiring hate speech transparency | cliQ Latest

In a legal move underscoring the growing tension between tech platforms and government regulations, Elon Musk’s social media platform X (formerly Twitter) has filed a lawsuit against the state of New York.

In a legal move underscoring the growing tension between tech platforms and government regulations, Elon Musk’s social media platform X (formerly Twitter) has filed a lawsuit against the state of New York. The lawsuit challenges a newly enacted law that requires social media companies to publicly report how they monitor and moderate hate speech and harmful content. Filed in Manhattan federal court, the lawsuit claims that the law, known as the Stop Hiding Hate Act, infringes on the platform’s First Amendment rights and forces disclosure of editorial judgments that should remain private.

X challenges reporting rules as unconstitutional

The Stop Hiding Hate Act, passed in December, mandates that social media platforms file detailed biannual reports explaining their definitions of hate speech, disinformation, extremism, harassment, and foreign interference — along with related statistics. Companies that fail to comply could face penalties of up to $15,000 per day per violation.

X argues that this law amounts to unconstitutional compelled speech, requiring platforms to take a public stance on complex and divisive topics. The company contends that decisions about what speech is permissible online vary greatly across the population and should not be dictated by government authorities. X draws comparisons to a similar law in California that it successfully challenged last year, citing that as precedent in its effort to have the New York law overturned.

Lawmakers defend the act amid growing concerns over online hate

In defense of the legislation, the bill’s sponsors — New York State Senator Brad Hoylman-Sigal and Assemblymember Grace Lee — argue the law does not limit speech but instead brings necessary transparency to how platforms handle harmful content. They described X as a “cesspool of hate speech” and stressed that New Yorkers have a right to know what tech companies are doing to curb the spread of hate and misinformation.

The lawsuit comes at a time when Elon Musk’s handling of content moderation at X has drawn widespread criticism. Since acquiring the platform in 2022, Elon Musk has loosened content policies, disbanded the Trust and Safety Council, and reinstated numerous banned accounts. Academic researchers and advocacy groups have reported a significant rise in hate speech and extremism on X, but Elon Musk has rejected these claims and even sued researchers documenting them — one of which was dismissed in court.

X has also been accused of targeting critical journalists and news organizations, suspending accounts and limiting traffic to outlets that publish unflattering reports about Elon Musk or his companies.
