TikTok has strongly criticized a proposed bill aimed at compelling the video-sharing platform to divest from its Chinese parent company, arguing that such legislative measures would infringe upon the fundamental right to free speech.
In a statement released on Sunday, TikTok expressed disappointment with the passage of the bill by the US House of Representatives, characterizing it as an encroachment on the free speech rights of millions of Americans. The bill, which received bipartisan support in a 360-58 vote, is now headed to the Senate for consideration.
The legislation, included in a broader aid package for Ukraine, Israel, and Taiwan, would require Chinese firm Byte Dance, TikTok’s owner, to divest from the app within nine months, with a potential three-month extension subject to presidential assessment of sale progress.
Concerns over national security have been central to bipartisan backing of the bill, with lawmakers suggesting that TikTok could be exploited by Beijing for espionage and propaganda purposes. Despite TikTok’s assertions that it has not shared American user data with the Chinese government and has no intention to do so, skepticism remains.
Critics of the proposed legislation, including civil liberties organizations like the American Civil Liberties Union and The Knight First Amendment Institute at Columbia University, have raised objections on free speech grounds. They argue that such measures could set a dangerous precedent for government interference in online expression.
This is not the first time TikTok has faced scrutiny from US authorities. In 2020, former President Donald Trump attempted to ban the platform via executive order, citing national security concerns. However, the move was blocked by the courts, which ruled that it violated free speech and due process rights.
As the bill advances to the Senate, the debate surrounding TikTok’s future in the US continues to underscore the delicate balance between national security interests and the protection of individual freedoms in the digital age.
