Billionaire entrepreneur Elon Musk has taken steps to dismiss his lawsuit against OpenAI and its CEO, Sam Altman, accusing them of deviating from the startup’s original mission of developing artificial intelligence for the greater good.
Attorneys representing Elon Musk filed a request in California state court to dismiss the lawsuit, originally filed in February. The reason for the dismissal was not provided in the filing.
The lawsuit’s dismissal without prejudice leaves open the possibility for Elon Musk to refile it in the future. OpenAI and representatives for Elon Musk have not immediately commented on the development.
Elon Musk’s legal action marked the culmination of his longstanding opposition to OpenAI, a startup he co-founded, which has received substantial funding from Microsoft and become synonymous with generative AI.
In response to OpenAI’s evolution, Elon Musk established his own artificial intelligence startup, xAI, last July. xAI recently raised $6 billion in series B funding, reaching a post-money valuation of $24 billion.
The lawsuit alleged that Altman and OpenAI co-founder Greg Brockman initially approached Elon Musk with the vision of creating an open-source, non-profit organization. However, Elon Musk contends that the startup, founded in 2015, shifted its focus to profit-making ventures.
Central to Elon Musk’s complaint was OpenAI’s release of its powerful language model, GPT-4, which Elon Musk argued violated the startup’s founding principles.
Elon Musk sought legal intervention to compel OpenAI to share its research and technology with the public and prevent the startup from leveraging assets like GPT-4 for financial gain, particularly benefiting Microsoft.
In response, OpenAI characterized Elon Musk’s claims as unfounded and suggested they were driven by his own AI interests. The startup argued that Elon Musk’s lawsuit was based on flawed premises.
Elon Musk, in a filing from April, countered OpenAI’s arguments, accusing the startup of advancing claims beyond the lawsuit’s scope.
The dismissal of the lawsuit signifies a pause in the legal battle between Elon Musk and OpenAI, though it leaves unresolved the underlying tensions regarding the future of AI development and its ethical implications.
