China’s revised State Secrets law raises concerns for foreign firms and Taiwan

China has implemented a revised state secrets law, prompting Taiwan to caution its citizens against traveling to China and causing unease among foreign companies fearing potential repercussions on regular business operations.

China has implemented a revised state secrets law, prompting Taiwan to caution its citizens against traveling to China and causing unease among foreign companies fearing potential repercussions on regular business operations.

The updated Law on the Guarding of State Secrets, effective as of Wednesday, signals China’s heightened focus on national security under President Xi Jinping’s administration. The revisions expand the law’s scope to encompass “work secrets,” which include information not classified as state secrets but could still have adverse consequences if leaked.

Moreover, the amended law mandates internet companies to cooperate with investigations into suspected leaks and to immediately halt the transmission of such information upon suspicion of state security breaches. Government agencies are also required to allocate resources for state secrets protection, with government employees handling such information subject to restrictions on employment changes and overseas travel.

Foreign firms operating in China express concerns over the law’s vague provisions and the potential impact on business activities. Uncertainty looms over the definition of “work secrets,” leaving room for arbitrary interpretations that could disrupt ordinary operations. While some legal experts downplay the law’s potential impact, advising companies to enhance data management practices, others warn of compliance challenges and the risk of self-censorship.

Taiwan, viewing the law as a threat, issues a warning to its citizens, citing increased risks associated with visiting China. The territory’s Mainland Affairs Council criticizes Beijing for using legislation to intensively monitor overseas visitors and urges the public to refrain from unnecessary travel to China amid the uncertain legal landscape.

The enactment of China’s revised state secrets law underscores broader concerns about national security and foreign relations in the region, with implications for both businesses and international travelers.
