Canada’s new visa rules pose major challenge for Indian students and workers | CliqExplainer

Canada’s latest immigration regulations have raised concerns among international students, workers, and migrants, particularly those from India, as they grant border officials sweeping powers to reject or cancel temporary resident permits.

Canada’s latest immigration regulations have raised concerns among international students, workers, and migrants, particularly those from India, as they grant border officials sweeping powers to reject or cancel temporary resident permits. The new rules, which came into effect in February, are expected to create significant uncertainty for thousands of Indian nationals studying, working, or planning to migrate to Canada.

The Immigration and Refugee Protection Regulations now empower Canadian border officials with the discretion to deny electronic travel authorizations (eTAs), temporary resident visas (TRVs), student visas, and work permits. Officials can also revoke these documents at any point if they believe the individual does not meet the criteria for continued stay. One key clause allows officers to reject an individual’s entry or cancel their permit if they are not convinced that the person will leave Canada upon the expiration of their authorized stay. The interpretation of this rule remains entirely at the discretion of immigration officers, adding an element of unpredictability to the process.

The new visa policies are expected to impact a vast number of Indian students and professionals who form the largest group of foreign nationals in Canada’s educational and employment sectors. According to government data, over 4.2 lakh Indian students are currently pursuing higher education in Canada, making it one of the top destinations for Indian youth seeking global opportunities. Additionally, Canada has a significant number of Indian professionals working in various industries under temporary work permits.

Under the revised framework, any student, worker, or migrant whose permit is denied at the port of entry will be immediately deported to their home country. Those already studying or working in Canada whose permits get revoked will be served with a notice to leave by a specified deadline. This sudden policy shift has raised concerns about the financial investments made by students and professionals, as there is no clarity on reimbursements for tuition fees, loans, mortgages, or rent payments in case of an abrupt deportation.

Apart from students and workers, Canada is also a major destination for Indian tourists, many of whom travel on temporary visas. In the first six months of 2024, Canada issued travel visas to over 3.6 lakh Indians, compared to 3.4 lakh in the same period in 2023. The impact of the new regulations on Indian tourists remains uncertain, but the possibility of sudden visa cancellations has left travelers wary.

Individuals affected by these changes will receive notifications via email and their official Immigration, Refugees and Citizenship Canada (IRCC) accounts. However, the lack of clarity on the consequences of permit cancellations has added to the growing anxiety among Indian nationals planning to move to Canada for education, work, or travel.

These developments follow Canada’s decision in November 2024 to shut down the Student Direct Stream (SDS) visa program, which was widely used by Indian students to secure their education in Canada. The SDS program allowed students to fast-track their visa applications by guaranteeing financial proof upfront. With this option no longer available, Indian students are now facing additional challenges in securing student permits under the new stringent immigration policies.

The sudden changes in Canada’s immigration policies have sparked criticism from affected communities, immigration experts, and Indian authorities. Many fear that these regulations will disrupt educational and career prospects for thousands of Indian nationals, potentially forcing them to reconsider Canada as a preferred destination for studies and employment.

The Indian government is closely monitoring the situation and has urged Canadian authorities to provide clarity on how the new rules will be implemented and whether there will be any provisions for those already residing in the country. Meanwhile, immigration consultants and legal experts are advising Indian students and professionals to be extra cautious while planning their move to Canada, as the unpredictability of visa approvals and rejections continues to rise.

As the situation unfolds, many are calling for diplomatic discussions between India and Canada to ensure that Indian nationals are not disproportionately affected by these sweeping immigration changes. For now, those aspiring to study, work, or migrate to Canada will need to navigate these uncertainties with careful planning and awareness of the latest regulatory updates.
