Cabinet approves online gaming bill to regulate e-sports and criminalize online betting in India | cliQ Latest

The Union Cabinet, chaired by Prime Minister Narendra Modi, on Tuesday gave its approval to the Online Gaming Bill, a landmark legislation aimed at regulating the rapidly growing sector of online games and e-Sports in India while simultaneously criminalizing online betting activities.

The Union Cabinet, chaired by Prime Minister Narendra Modi, on Tuesday gave its approval to the Online Gaming Bill, a landmark legislation aimed at regulating the rapidly growing sector of online games and e-Sports in India while simultaneously criminalizing online betting activities. The move comes amid increasing concerns about the rise of fraudulent online gaming platforms and the associated financial scams, which have affected both ordinary players and celebrities endorsing such services. According to sources cited by ET, the bill is expected to be introduced in the Lok Sabha as early as tomorrow, signaling the government’s urgent intention to establish a regulatory framework for the online gaming industry. The legislation seeks to promote legitimate e-Sports and social gaming activities, while strictly prohibiting money-based online gaming and betting, imposing stringent penalties, and empowering authorities with investigative and enforcement powers.

Regulation of E-Sports and Promotion of Online Social Games

The Online Gaming Bill represents a significant step toward formalizing the digital gaming ecosystem in India. While the legislation strictly prohibits money-based gaming and betting, it simultaneously encourages the growth and promotion of e-Sports and online social games. According to the official text, the bill allows the creation of a regulatory authority or the designation of an existing governmental agency to oversee the operations, standards, and governance of online gaming. This authority will be responsible for ensuring transparency, enforcing compliance, and monitoring industry practices, thereby providing a structured environment for the growth of competitive gaming in India.

E-Sports, which have gained immense popularity both domestically and globally, will be supported under this framework, providing professional players with a legally recognized platform to compete in tournaments and championships. Online social games, which do not involve real-money transactions, will also be encouraged as they contribute to the entertainment industry, foster technological innovation, and generate employment opportunities. By separating money-based gaming from legitimate social and competitive gaming, the government aims to provide a safe environment for players and prevent the misuse of online platforms for illegal financial gains.

Moreover, the bill recognizes the importance of establishing clear legal guidelines for gaming operators, advertisers, and financial institutions. This ensures that the burgeoning e-Sports industry can thrive while protecting players from fraudulent schemes and preventing the exploitation of online platforms for illegal betting. The regulatory framework proposed in the bill also includes measures to oversee the advertising of online games, ensuring that promotions are ethical and do not encourage participation in money-based gaming activities.

Prohibition of Online Betting and Legal Consequences

A core objective of the Online Gaming Bill is to prohibit online money-based gaming and betting activities, which have surged in India in recent years, often accompanied by financial scams and fraudulent practices. The legislation explicitly criminalizes the offering, aiding, abetting, or inducing any online money gaming service, and makes it a punishable offense under the law. Similarly, creating or facilitating advertisements that encourage participation in money-based online games is also deemed an offense, with penalties prescribed for both first-time and repeat offenders.

Financial transactions related to online betting are another area of focus under the bill. It prohibits banks, financial institutions, and any other entities or individuals from facilitating payments for online money-based games. Any attempt to authorize, permit, or process such transactions will be considered a violation of the law, with legal consequences extending to individuals, organizations, and intermediaries involved in facilitating such payments. The legislation empowers authorities to investigate, search, and seize property connected to violations, ensuring strict enforcement against illegal gaming networks.

Additionally, the bill prescribes fines and imprisonment for offenders, with more severe consequences for repeated violations. Regulatory authorities are also granted the power to block information related to online money-based games, ensuring that fraudulent platforms cannot continue operations under the guise of legitimate gaming services. By combining prohibitive measures with a structured regulatory framework for legitimate gaming, the government aims to create a balanced approach that fosters industry growth while curbing illegal activities.

The urgency behind this legislation is underscored by a recent spike in fraud cases involving online gaming platforms, where unsuspecting players and even high-profile personalities have fallen victim to deceptive practices. Investigative agencies have increasingly focused on monitoring these activities, particularly when celebrities endorse such platforms without due diligence, further amplifying the need for a strong regulatory framework. The Cabinet’s approval of the bill signals India’s commitment to protecting citizens from online fraud while simultaneously enabling the responsible growth of the gaming industry.

The Online Gaming Bill represents a comprehensive approach to managing the online gaming sector in India. By clearly defining permissible activities, empowering regulatory authorities, prohibiting money-based gaming, and imposing stringent penalties for violations, the legislation seeks to balance growth and regulation in a fast-evolving digital landscape.
