Supreme Court grants interim bail to Delhi CM Arvind Kejriwal until June 1

Supreme Court has granted interim bail to Delhi Chief Minister Arvind Kejriwal, providing relief to the national convenor of the Aam Aadmi Party (AAP) in the midst of ongoing legal proceedings. The bail comes with a stipulation for Arvind Kejriwal to surrender on June 2, a day following the conclusion of the seven-phased Lok Sabha elections.

The apex court’s decision to grant interim bail to Arvind Kejriwal was accompanied by a pointed observation regarding the Enforcement Directorate’s (ED) handling of the case. Justices Sanjiv Khanna and Dipankar Datta, constituting the bench, highlighted the delay in the ED’s actions, noting that while an Enforcement Case Information Report (ECIR) had been filed in August 2022, Kejriwal’s arrest only occurred in March.

The bench underlined the prolonged duration during which Arvind Kejriwal remained unarrested, stating, “For about one and a half years he was there… The arrest could have been made afterward or before. 21 days here or there should not make any difference,” reflecting a critique of the timing of the arrest in relation to the ongoing legal process.

Arvind Kejriwal, who has been incarcerated in Tihar jail under judicial custody since his arrest on March 21, found recourse in seeking temporary release to actively participate in campaigning for the Lok Sabha elections. The interim bail granted by the Supreme Court offers Arvind Kejriwal an opportunity to engage in electoral activities during a crucial phase of the political landscape.
