Eminent jurist and distinguished constitutional lawyer Fali Nariman passed away at the age of 95.
He was renowned for his exceptional oratory skills and sharp advocacy.
Often referred to as the “Bhishma Pitaamah” of the Indian judiciary, he played a pivotal role in numerous landmark judgments that reshaped the legal landscape of the country.
Throughout his illustrious career, Nariman appeared in a plethora of Constitution bench cases, where his legal acumen aided the Supreme Court in interpreting constitutional provisions and redefining the legal fabric of the nation. Notable cases include the Golak Nath case, which established the principle that even constitutional amendments are amenable to judicial review, and the TMA Pai case, which upheld the right of minorities to establish educational institutions of their choice.
Further, his unwavering commitment to the independence of the judiciary was evident in cases like SP Gupta and NJAC, where he vehemently advocated for the autonomy of the judiciary in the appointment of judges.
Apart from his legal prowess, Nariman was also a prolific author, penning insightful books such as “Before the Memory Fades” and “The State of the Nation,” among others, which offered invaluable perspectives on India’s legal system and governance.
PM Modi and political fraternity pays their tribute
Following the news of his demise, Prime Minister Narendra Modi took to social media to express his condolences, praising Nariman as one of the most outstanding legal minds and intellectuals who dedicated his life to making justice accessible to all citizens.
“Shri Fali Nariman Ji was among the most outstanding legal minds and intellectuals. He devoted his life to making justice accessible to common citizens. I am pained by his passing away. My thoughts are with his family and admirers. May his soul rest in peace,” PM Modi said.
Further, Finance Minister Nirmala Sitharaman and Union Minister Kiren Rijiju also paid their respects, remembering Nariman.
Finance Minister Nirmala Sitharaman paying her obeisance to the late Jurist Nariman said, “Very sad to know that Jurist Fali Nariman is no more. Wise, witty, a walking institution himself, Fali Nariman will be greatly missed. Only a few months ago, had an opportunity to meet with him. Affectionate and respected, India loses an icon.”
While Union Minister Kiren Rijiju in his message added, “Deeply Saddened by the demise of Shri Fali Nariman, Constitutional lawyer, Jurist and former Additional Solicitor General of India known for his unwavering opposition to authoritarianism during the Emergency. Throughout his illustrious career, he upheld principles of justice & ethics, as exemplified by his Padma Vibhushan honour. My thoughts are with his family and friends during this difficult time.”
