Billionaire entrepreneur Elon Musk has taken steps to withdraw his lawsuit against OpenAI and its CEO Sam Altman. The lawsuit, initially filed in February, accused the AI developer of deviating from its original mission of promoting AI for humanity’s benefit.
In a filing made in the California state court, Elon Musk’s attorneys requested the dismissal of the lawsuit without providing a specific reason. A hearing for OpenAI’s motion to dismiss the lawsuit was scheduled for Wednesday in the San Francisco Superior Court.
Elon Musk’s decision to dismiss the case without prejudice implies that he retains the option to refile it at a later time, should he choose to do so.
The legal action marked the culmination of Elon Musk’s longstanding concerns regarding OpenAI, a startup he co-founded. Elon Musk has criticized the company’s shift towards profit-making endeavors, diverging from its initial focus on open-source, non-profit AI development.
Last July, Elon Musk established his own AI startup, xAI, which secured significant funding, reaching a post-money valuation of $24 billion.
The lawsuit highlighted Elon Musk’s contention that OpenAI violated its founding principles by prioritizing financial gain, particularly evident with the release of its lucrative language model, GPT-4.
Elon Musk sought judicial intervention to compel OpenAI to make its research and technology accessible to the public, while also preventing the company from leveraging its assets for the financial interests of entities like Microsoft.
In response, OpenAI argued that Elon Musk’s claims lacked coherence, portraying the lawsuit as an attempt to advance his personal AI interests.
Elon Musk, in a filing submitted in April, accused OpenAI of presenting arguments based on disputed facts that extended beyond the lawsuit’s scope.
The withdrawal of the lawsuit signifies a potential de-escalation of tensions between Elon Musk and OpenAI, though the underlying disagreements regarding AI development and ethics remain unresolved.
